Terms of Service / Data Entry Agreement

• I understand that HelpMeSell.com and my FSBO Coach are NOT A REAL ESTATE BROKERAGE OR LICENSED REAL ESTATE AGENT and that HelpMeSell.com and my FSBO Coach ARE NOT REPRESENTING ME in the sale of real property and that HelpMeSell.com is an Internet Marketing and Data Entry Service that will assist in data entry procedures required to market my own home for sale by owner to the Internet public.
• HelpMeSell.com will NOT RECEIVE a commission from the sale of my property.
• I hereby authorize the HelpMeSell.com data entry team to register website user accounts on my behalf in order to create photo ads, links, shared content etc. on any third party website.
• I hereby authorize the HelpMeSell.com data entry team to submit my property information, description, photos, telephone number, email address etc. on public pages of any third party website on my behalf.
• I hereby authorize the HelpMeSell.com data entry team to register an email account on my behalf in order to create a dually accessible email account.
• I hereby authorized HelpMeSell.com to refer my listing to a licensed real estate brokerage or licensed real estate sales person who will place my home in the Multiple Listing Service for 0% commission. I authorize such brokerage or agent to offer compensation of 3% to any agent that sells my home by providing me with an acceptable contract with acceptable sale price and terms.
• I hereby authorize the HelpMeSell.com data entry team to sign digital documents on my behalf on third party websites when said documents are specific to an agreement between myself and such third party regarding marketing the home or regarding compensation to any licensed real estate professional.
• I hereby acknowledge and agree that I am solely responsible for the content I provide to HelpMeSell.com. I hereby certify that the property description I provide to HelpMeSell.com is true and accurate to the best of my knowledge.
• I agree to notify my HelpMeSell.com Coach immediately when I receive an offer on my home when I receive a fully executed purchase contract when I learn my closing date the day I close the transaction with a title company.
• I acknowledge that my FSBO Coach is a Mortgage Loan Officer and will use my best efforts to tell potential buyers that they can obtain a free mortgage loan pre-qualification from the HelpMeSell.com website. In consideration of services provided by HelpMeSell.com I acknowledge that all sales are final.
• I agree to the terms of the HelpMeSell.com 100% Money Back Guarantee.
• HelpMeSell.com reserves the right to edit or reject any listing at our discretion.
• By using this service you agree not to post or transmit any defamatory, abusive, obscene, threatening, misleading, or illegal material, or any other material that infringes on the rights of others or interferes with the ability of others to enjoy HelpMeSell.com.
• You will not use the service to violate the copyright, trademark, or other intellectual property rights of any person or other entity. By submitting material to HelpMeSell.com, you are representing that you are the owner of the material, or are making your submission with the explicit consent of the owner.
• By entering my personal information on this website, I intend and consent to their use as an electronic signature, equivalent to my handwritten signature as provided under applicable federal and state law. This electronic signature shall only apply to the Terms and Conditions of this contract as stated on this screen.

1. You understand that access to and use of the Site, including the services and features therein, are at your own risk. You further agree that none of our company, its' owners or affiliates, nor the web designer(s), internet hosting service, sponsors, partners or advertisers of the Site will be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of access to or use of the Site. You understand that all of the information appearing on the Site is provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. 
2. You further understand that all your listing information, including, but not limited to, company name, address, contact information (including telephone and fax numbers, e-mail and web addresses, etc.), but excluding login username and password, credit card and certain other information, are all available for public viewing. In addition, we actively promote and encourage the public to come to view those listings. Therefore, you should expect to be contacted by various parties including, but not limited to, parties looking for space, parties with available space, real estate brokers, salespeople and vendors for various types of products and services, etc. By posting a listing on our site, you are giving your permission and agreeing to be contacted by us and anyone else who may publicly view your listing. You may delete your listing at any time by using your login information and following the online instructions. 3. We do not guarantee the accuracy of the listings or other information appearing on the Site, and such information is subject to errors, omissions, changes in price, prior sales, rentals, and withdrawals without notice. Furthermore, any listing appearing on the Site is for informational purposes only and does not constitute an offer to sell or lease.
4. We do not warrant or make any representations of any kind or nature with respect to the information contained in the Site, and you are solely responsible for compliance with any applicable real estate laws or other applicable state or federal regulations. It is your responsibility to independently verify any statement made within any listing and to consult with engineering, architectural or other professionals as may be appropriate to determine the condition and suitability of any particular property for the purpose for which you intend to use it. 
5. We do not warrant or make any representations of any kind or nature as to the following: (a) the character or credit worthiness of those who (i) browse and/or utilize the listings appearing on our Site; (ii) place listings on our Site; or (b) the suitability for any particular purpose, compliance with applicable zoning, environmental or any other laws, quality of space and/or services to be provided pursuant to listings appearing on our Site.
6. Neither our company nor its owners, or partners shall be responsible for content appearing on third party sites which are linked to the Site. Nor shall we have any responsibility for any incentives (regardless of form) that may be offered by anyone other than in connection with a particular listing. You agree to look solely to the third party offering such incentive to fulfill its agreement with you and you hereby hold us harmless and release us from any liability whatsoever in connection with any third-party incentive offer.
7. Neither us nor our owners, or partners shall be responsible for any damage caused to your computer, or for viruses which may affect your computer as a result of accessing the Site or utilizing any of the services or features which appear therein.
8. As a condition of your use of the Site, you agree that you will not (a) restrict or attempt to restrict others from using the services or features appearing on the Site, in whole or in part, or (b) post or transmit any of the following to or through the Site: (i) pornographic, sexually explicit photographs or language, including expletives and other obscenities or otherwise unlawful material; (ii) information which violates the rights of others; (iii) information, software or other digital communication which contains a virus or other damaging or disruptive component; or (iv) any advertising or promotional materials.
9. This Agreement shall be governed by law. You agree that jurisdiction and venue of all matters relating to this Agreement will be vested exclusively in the federal, state and local courts within the state of this company, without regard to choice of law provisions.
10. We may revise the terms and conditions of this Agreement at any time, and you shall be bound by such revisions. Therefore, we urge you to review this Agreement regularly for any changes. You agree to indemnify, defend and hold harmless , our owners, partners, and sponsors against any and all claims, damages, costs or other expenses arising out of your violation of any of the terms and conditions herein.
11. We own all rights in and to the Site, including all of the information therein, or has obtained the proper licenses to use certain material. Except for the limited, personal, non-commercial, revocable right to view the copyrighted and trademarked content appearing on the Site, no expressed or implied license is otherwise granted to you in connection with use of the Site. Any unauthorized use of the Site or a copy thereof, in whole or in part, is prohibited. You are solely responsible for complying with all applicable U.S. and international intellectual property laws in connection with the Site and its content.
12. This Agreement is effective until terminated by us, which termination may occur at any time without notice if we believe in our full discretion that you have violated any of the terms herein. Upon termination of this Agreement, you hereby agree to destroy immediately all information, including all copies, which have been obtained from the Site, and you acknowledge and agree that you will no longer be authorized to access the Site or any of the services or features therein upon such termination.
